Purchase contract / order
Customers can place orders using the online form provided for this purpose. You place the order by sending the order of the products contained in the shopping cart.
All offers are subject to change. Johnny-Tapete reserves the right to refrain from accepting the order in the event of errors, spelling mistakes or miscalculations. If an ordered item is not available contrary to the availability display in the webshop, we are entitled to release ourselves from the contractual obligation to deliver. However, we undertake to inform you immediately of the unavailability and to reimburse any payments received without delay. Errors and changes are expressly reserved.
A legally binding purchase contract is concluded when you place an order and we accept the order and send the pro forma invoice to the e-mail or postal address you have provided.
The contract data is stored for the fulfillment of the contract and any complaints.

Cancellation policy A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.
To exercise the right to cancel, you must inform us (Simone Schäfer & Falco Kleinschmidt GbR, Semperstr. 11, 45138 Essen, phone: +49-(0)201-6124647 or email: info@johnny-tapete.de) of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or email). You can use the attached sample withdrawal form, but this is not mandatory.
To comply with the revocation period, it is sufficient for you to send the notification of the exercise of the right of revocation before the expiry of the revocation period.Consequences of withdrawal
If you withdraw from this contract, we will reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us).we will refund all payments we have received from you, including delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the day on which we receive notification of your revocation of this contract.
For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the revocation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You shall bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.Sample withdrawal form

Prices / Shipping costs
The prices stated at the time of ordering apply. We are subject to differential taxation according to §25a UStG.
Packaging and shipping costs will be invoiced separately. The amount of the costs will be calculated depending on the weight and/or size of the shipment and will be communicated to the customer in advance by e-mail before the final acceptance of the order. Johnny-Tapete always selects the cheapest option for the customer.
If the shipment is made outside the EU, customs duties may be payable by the recipient. -
Invoicing / Payment / Due date / Retention of title
Invoices shall be issued for the purchase price of the goods and the stated packaging and shipping costs, as specified in the order confirmation or advance invoice.
Unless otherwise agreed, payments shall always be made in advance by bank transfer or deposit to our account.
Please do not send cash or checks for payment. We exclude any liability for loss.
Johnny-Tapete reserves the right to withhold deliveries and/or services until full payment has been made in the event of late payment.
The goods remain the property of Johnny-Tapete until full payment has been made.

Liability / Warranty
Please note that the commodities and antiques offered here - in particular electrical appliances and lamps - may not be subject to current safety regulations. For your own safety and to avoid danger to body, health or life for yourself or other persons, it is therefore strongly recommended that you seek the advice of a specialist in the field of electronics/electrical engineering before using electrical appliances and lamps and have them technically checked for any dangers they may pose.
The warranty for the delivery of new items to consumers is 2 years. An item is considered new if it has the following characteristics:
Unused and unopened product in very good condition (brand new), not a display or demonstration item, all manufacturer's seals, if any, are intact. Complete original packaging, which may show minor signs of storage, and original scope of delivery are present. The manufacturer's initial warranty, if applicable, is still valid.
Towards consumers, the warranty for the delivery of used items (antiques, second-hand) is limited to 1 year; this does not apply in cases of § 309 S. 1 No. 7 BGB.
In all cases of slight negligence, the warranty is limited to the foreseeable damage.
No warranty is assumed towards entrepreneurs with regard to used articles; liability towards entrepreneurs is also excluded in particular in the cases of § 309 sentence 1 no. 7 BGB. The provisions of the HGB remain unaffected.

Delivery
Delivery is made against prepayment. After receipt of payment on our account, we will ship the following working day. Your goods will be delivered by DHL or UPS.
Delivery in absence: Please make sure that a person is present on the day of delivery or that a neighbor can accept your delivery.

Delivery reservation
In the event of strikes, labor disputes, lockouts or official measures as well as the occurrence of unforeseen events beyond our control, such as operational disruptions or delays in the delivery of essential materials, we release ourselves from the obligation to deliver for the duration of these hindrances, provided that they can be proven to have a significant influence on the delivery of the delivery item. If the hindrance lasts longer than six weeks, both the Customer and Johnny-Tapete have the unilateral right to withdraw from the contract.

Data protection
In accordance with § 28 of the Federal Data Protection Act, it is pointed out that the data required in the context of business transactions are processed and stored by means of an EDP system in accordance with § 33 of the Federal Data Protection Act. Principles / General
Our terms and conditions are the basis for all deliveries and services that we process with the Johnny-Tapete-Webshop based in Essen and shipping from Essen based on online orders via the Internet.
With every electronic order process, you as a customer receive knowledge of these General Terms and Conditions (GTC). It is not possible to place an order online without knowledge of these terms and conditions and without confirmation that you accept them.
You are deemed to have accepted the General Terms and Conditions when you place an order, but at the latest when you accept the delivery. Deviating and/or supplementary agreements on your part are not valid even if they are not expressly contradicted. They always require our prior written consent.

Place of jurisdiction
The place of jurisdiction for all disputes arising from the contractual relationship between the customer and the provider is the registered office of the provider, provided that the customer is a merchant, a legal entity under public law or a special fund under public law. -
Final provisions
Should individual provisions of this contract be or become void, ineffective or contestable, the remaining provisions shall remain unaffected and shall then be interpreted or supplemented in such a way that the intended economic purpose is achieved as precisely as possible in a legally permissible manner. This also applies to any loopholes that may need to be filled.
