Purchase Contract / Order
Orders can be placed as a customer in the designated online form. You issue the order by sending the order of the products in your shopping cart.
All offers are free of charge. Johnny-Tapete reserves the right to distance itself from errors in the order acceptance. If an ordered item is not available in the webshop, we are entitled to release ourselves from the obligation to deliver. We will inform you immediately about any non-availability and reimburse any received benefits immediately. Errors and changes remain expressly reserved.
With your order placement (order) and our order acceptance as well as the sending of the proforma invoice to the email address or postal address you provided, a legally binding purchase contract comes into effect.
The contract data is stored to fulfil the contract and for any claims.

Revocation Notice
Consumer is any natural person who concludes a legal transaction for purposes that predominantly neither belong to their commercial nor their independent professional activity.
Revocation Right
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.
To exercise your right of withdrawal, you must inform us (Simone Schäfer & Falco Kleinschmidt GbR, Semperstr. 11, 45138 Essen, tel: +49-201-6124647 or email: info@johnny-tapete.de) by means of a clear declaration (e.g. a letter sent by post, fax or email) about your decision to withdraw from this contract. You can use the attached model revocation form, but it is not required.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the additional costs that arise from the fact that you have chosen a different method of delivery than the cheapest standard delivery offered by us), without undue delay and not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract.
For this repayment we use the same payment instrument that you used in the original transaction, unless something else has been agreed with you expressly; in no case will you be charged for this repayment. We can refuse the repayment until we have recovered the goods or until you have provided proof that you have sent the goods back, whichever is earlier.
You must send the goods back to us immediately and at any time within fourteen days from the day on which you inform us about your decision to withdraw from this contract. The deadline is observed if you send the goods before the deadline of fourteen days. You bear the immediate costs of returning the goods. You must only bear the possible loss of value of the goods if this loss of value is attributable to a handling of the goods that is not necessary for the inspection of the quality, properties and functionality of the goods.

Prices / Shipping Costs
The prices stated at the time of ordering apply. We are subject to differential taxation according to §25a UStG.
Packaging and shipping costs are charged separately. The amount of costs is calculated depending on the weight and/or size of the shipment and communicated to the customer in advance by email before final order acceptance. Johnny-Tapete always chooses the most favorable option for the customer.
If the shipment is outside the EU, sometimes customs duties may be payable, which the recipient must pay. -
Invoicing / Payment / Due Date / Retention of Title
The invoicing is done via the purchase price of the goods and the specified packaging and shipping costs, as specified in the order confirmation or proforma invoice.
Unless otherwise agreed, payments are generally made in advance by bank transfer or deposit to our account.
Please do not send cash or checks for payment. We exclude any liability for this.
Johnny-Tapete reserves the right to withhold deliveries and/or services until full payment has been made.
Until full payment has been made, the goods remain the property of Johnny-Tapete.

Liability / Guarantee
Please note that the goods and antiques offered here – especially electrical devices and lamps – may not comply with the current safety regulations. For your own safety and to avoid dangers to your body, health or life for yourself or other persons, it is therefore strongly recommended to consult an expert in the field of electronics/electrotechnics before putting electrical devices and lamps into operation and to have them checked for any dangers that may emanate from them.
The guarantee for the delivery of new goods to consumers is two years. A good is considered new if it has the following characteristics:
Unused and unopened product in very good condition (factory new), not an exhibition or performance object, all manufacturer's seals are intact. Complete original packaging, which may have slight storage marks, as well as original delivery contents are present. The manufacturer's first guarantee, where applicable, is still valid.
The guarantee for the delivery of used goods (antiques, second-hand) to consumers is limited to one year; this does not apply in cases of § 309 S. 1 Nr. 7 BGB.
The guarantee is limited to negligence in all cases to the foreseeable damage.
The guarantee is not taken out for used goods against entrepreneurs; the liability towards entrepreneurs is also excluded in particular in cases of § 309 S. 1 Nr. 7 BGB. The provisions of the HGB remain unaffected.

Delivery
The delivery is made against prepayment. After the payment has been credited to our account, we will send it on the following working day. The delivery of your goods is made with DHL or UPS.
Delivery in absence: Please make sure that a person is present on the day of delivery or a neighbour can take your delivery.

Delivery Reservation
In the event of strikes, industrial disputes, lockouts or official measures as well as the occurrence of unforeseen events that are outside our sphere of influence, such as breakdowns or delays in the delivery of essential materials, we are exempt from the obligation to deliver for the duration of these hindrances, provided that they are demonstrably of significant influence on the delivery of the delivery object. If the hindrance lasts longer than six weeks, both the customer and Johnny-Tapete have the right to withdraw from the contract.

Privacy
According to § 28 of the Federal Data Protection Act, it is pointed out that the data necessary for the conduct of business are processed and stored by means of an IT system in accordance with § 33 of the Federal Data Protection Act. General
Our general terms and conditions are the basis for all deliveries and services that we conduct with the Johnny-Tapete-Webshop with its seat in Essen and delivery from Essen on the basis of online orders via the Internet.
With each electronic order process, you as a customer receive notice of these general terms and conditions (GTC). An order without knowledge of these terms and conditions and without confirmation that you accept them is not possible online.
With order placement (order), at the latest with the acceptance of the delivery, the general terms and conditions are deemed to have been accepted by you. Deviating and/or supplementary agreements on your part are also invalid if they are not expressly opposed to them. They generally require our prior written consent.

Jurisdiction
The jurisdiction for all disputes arising from the contractual relationship between the customer and the supplier is the seat of the supplier, provided that the customer is a merchant, a public legal person or a public-law special fund. -
Final Provisions
If individual provisions of this contract are invalid, ineffective or subject to appeal, the other provisions remain unaffected and are then construed or supplemented so that the intended economic purpose is achieved in the legally permissible manner as exactly as possible. This also applies to potentially supplementary gaps.
